Some states do not allow the exclusion or limitation of punitive, incidental or consequential damages, so the prior limitation or exclusion may not apply to you.
All provisions of Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
Disclaimer
Due to the very nature of Fireplaces, Combustion Stoves, Stoves, Barbeques, Grills, Furnace, Chimneys and or any heart for burning wood or coal product in general, and ancillary related items, which are implicitly and expressly dangerous, unless utilized within very specific parameters, the Company, New Joules Engineering North America, Inc., as a company, its employees, staff or affiliate’s accept no responsibility arising from or in respect of any harm, howsoever or from whatsoever cause arising, in respect of any damage/injury/suffering whatsoever, occurring to any person or thing, whether of a corporeal, incorporeal or injurious nature, the meaning of which words shall be given the maximum and widest definition (hereinafter referred to as “harm”), and arising from the incorrect use, abuse, placement of items or equipment of the Company, including any hearth for burning wood or coal manufactured or supplied by the Company or any ancillary or extraneous parts in which or to which such wood or coal burning product may be installed. This general disclaimer further extends to all or any persons, including the public at large, who may be in the proximity of, or in the presence of any person, happening or incident, of whatsoever nature, or from whatsoever cause arising, and which may lead, directly or indirectly, to harm to such person or property, and in respect of which such parties, including the public at large, hereby expressly waive and abandon all or any claims, actual or perceived, of whatsoever nature and from whatsoever cause arising, in respect of any harm, whether direct or indirect, including any consequential harm arising therefrom, or from the presence of and/or utilization of any items, product or service supplied by the Company. The onus and thus liability remains on the customer/purchaser/end user/installer to ensure that the installation of product(s) complies with the specific destination local building and fire codes.
GOVERNING LAW
These Terms shall be governed and construed in accordance with the laws of United States, which governing law applies to agreement without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have had between us regarding Service.
CHANGES TO PRODUCT
We reserve the right to withdraw or amend the Product, and any service or material we provide via Service, in our sole discretion without notice. We will not be liable if for any reason all or any part of Service is unavailable at any time or for any period. From time to time, we may update the Product, its design and its price.
